PROBLEM PROJECT SERVICES:
We understand that once a project goes off the rails, it can be very difficult to get it back on track. That is where we render some of our most valuable services-often times without anyone knowing that we are even involved.
Because we are not personally invested in the project, we can look at the issues with an unbiased eye, and help you find novel solutions before the problem goes to litigation. These activities often involve ghost writing notice and letters to help you shape the battlefield before the legal shooting begins. Once the battlefield has been shaped, we often find that it is much easier to negotiate a constructive solution that helps everyone avoid court altogether.
A good example of problem project services involved construction of a $500 million hospital project for NIH that was administered by GSA. GSA retained a developer to plan the program and construct the Project. As required by GSA, the developer entered into a cost reimbursable construction contract with a general contractor that incorporated FAR clauses regarding reimbursable costs and termination. The general contractor was not performing, and we worked with the developer to develop and implement a strategy to replace the general contractor during the midst of construction. This strategy involved extensive work with Government officials to ensure compliance with the FAR. As a result of careful planning and documentation, we were able to transition from one contractor to another while avoiding litigation altogether.
